Business Services and Scope

Right Laser Cut Pty Ltd is an Adelaide-based metal fabrication business offering precision laser cutting and related services for a diverse range of industries. We cut sheet metal and tube (including steel, aluminium, etc.) and provide finishing services such as powder-coating and electroplating. Our offerings also include CAD design support, bending, engraving and other CNC machining or fabrication work as needed. Since 2021 we have emphasized high-quality workmanship, fast turnaround and competitive pricing. Our services are provided with due care and skill and are fit for the specified purpose, in line with our commitment to precision and customer satisfaction. (Where applicable, completed products come with any manufacturer or statutory warranties; see Consumer Guarantees below.)

Customer Obligations

As a customer (or “you”), you agree to provide complete and accurate information for your order. You must supply correct specifications, design files and delivery details. You warrant that any designs or materials you provide are your own or licensed to you; in particular, you must not submit any content that infringes third-party intellectual property rights. You must ensure that any drawings or logos are lawful, safe and not deceptive or offensive. If we instruct you (for example, to return a product for inspection), you must comply with those reasonable instructions to facilitate service or returns. You also agree to pay for orders promptly as set out below, and to use our website and services lawfully (e.g. not attempt to abuse the quoting system or upload malicious content).

Pricing and Payment Terms

Prices are in Australian dollars (AUD) and include GST where applicable. Exact prices will be quoted or listed on the website; all quotes or orders are subject to final confirmation. Payment in full is required before work commences. We accept payment by credit card, EFT (bank transfer) or other methods as advertised. Order acceptance: No order is binding until we confirm it in writing (email or invoice) after receiving payment. If a quoted price or invoice contains a typographical error, we reserve the right to correct it. In such a case, we may contact you to confirm whether to proceed at the corrected price, or cancel the order. Similarly, if we agree to supply an item at a lower price than quoted, we will honour the lower price or refund the difference. We may also reserve the right to cancel the order if payment is not received within a reasonable time, refunding any amount paid. Any bank, transaction or currency fees are payable by you.

Order Process and Delivery

Orders are placed via our website, email or by phone. Once you have approved a design and paid, we will schedule the work. You will be given an estimated completion date, but exact timing depends on workload and any material supply issues. In any case, services will be supplied within a reasonable time as required by the Australian Consumer Law.

Upon completion, goods will be dispatched by courier or made available for pickup. Shipping costs and arrangements are at your expense unless stated otherwise. We will notify you when your order is shipped. You should inspect goods on receipt; risk of loss or damage passes to you on delivery (or on pickup, if you collect). Right Laser Cut is not responsible for losses or damages in transit or for delivery delays beyond our control. We endeavour to ship items promptly, but factors such as courier schedules or supply delays may affect timing. If a delivery date slips significantly (e.g. by more than 7 days beyond our estimate), we will notify you so you can choose to cancel or continue the order. If you arrange your own pickup or delivery, you assume all responsibility once the goods leave our facility.

Refunds and Cancellations

Change of mind: As a custom manufacturing business, we generally do not offer refunds or returns for “change of mind” on custom orders. Please check your order carefully before confirming. However, under the Australian Consumer Law (ACL) you are entitled to remedies if goods or services are faulty or not as described. It is against the law for us to mislead you about these rights (for example, we cannot lawfully display a “no refunds” sign to deny statutory rights).

Faulty or misdescribed items: If a product or service is defective, does not meet the specifications we confirmed, or breaches a consumer guarantee, you may claim a repair, replacement or refund in accordance with ACL requirements. We will process such refunds promptly (typically within 10 business days). Faulty items returned for remedy should be accompanied by the original packaging and accessories if reasonably practical【58†L295-302】; however, if a product cannot be safely returned (e.g. due to size or safety), we will work with you under ACL provisions. You must follow our return instructions so we can assess the issue【58†L295-302】. Returned goods remain at your risk until they reach us, and we do not cover return postage except where required by law.

Order cancellations: If you cancel an order before production begins, we may retain a reasonable portion of any deposit or charge a cancellation fee to cover materials already procured. Once we have begun cutting or processing your order, it is considered final and cannot be cancelled (aside from exercising consumer guarantees). If we ourselves must cancel (for example, due to inability to source material or severe delays), we will notify you and refund any amounts paid without undue delay. In all cases, your statutory rights under the ACL apply – nothing in these terms is intended to restrict the consumer guarantees provided by law.

Intellectual Property and Custom Designs

Your IP: You retain ownership of any designs, drawings or logos you provide for production. You grant Right Laser Cut a licence to use those designs only for completing your order. You warrant that you have the legal right to use all content you supply and that it does not infringe others’ intellectual property or other rights. You also warrant that any designs are suitable and legal for their intended use.

Our IP: Right Laser Cut retains all copyright and other intellectual property rights in any custom designs, CAD drawings, artwork, or technical work we create during the project. Completed parts are yours to use, but any underlying design files or proprietary data remain our property unless we agree otherwise in writing. You may not copy, distribute or reuse our design work beyond its intended purpose without our permission. Similarly, all content on our website or in our marketing (text, images, logos, etc.) is the property of Right Laser Cut or our licensors, and you must not use it without authorization. We reserve the right to photograph or feature finished work in our portfolio or advertising, unless you specifically instruct us otherwise.

Liability Limitations

To the extent permitted by law, Right Laser Cut’s liability for any claim arising from or connected to our goods and services is limited to the amount you paid for those goods or services. We will not be liable for any indirect, incidental, special or consequential losses (such as loss of profit, business or data) even if foreseeable. For example, we do not compensate for damages caused by misuse of products or installation errors after delivery. Nothing in these terms excludes or limits liability for personal injury or death caused by our negligence, or any other liability that cannot be excluded under the Competition and Consumer Act 2010 (Cth). In particular, your rights under the ACL cannot be removed by this contract. Any advice or recommendations we give (for example, regarding material choice or finish) are given in good faith but do not form a binding guarantee unless expressly confirmed in writing.

Applicable Law and Dispute Resolution

These terms are governed by the laws of the State of South Australia and the Commonwealth of Australia. You agree to submit to the exclusive jurisdiction of the courts of South Australia. Any dispute arising under these terms will first be addressed in good faith by negotiation. If unresolved, the dispute may be referred to mediation or arbitration (optional), and ultimately the South Australian courts. This does not prevent either party from seeking urgent injunctive relief. (Parties are responsible for their own legal costs unless a court orders otherwise.)

Effective date: These Terms and Conditions are effective as of the date shown on this page. We reserve the right to amend these terms at any time; updated versions will be posted on our website with a new effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
